Funds Availability PolicyCommerce National Bank's goal is to provide the earliest availability of funds to the customer as possible, given the degree of risk associated with the deposit and the amount of time necessary to ensure that a deposited check will be paid. Commerce National Bank will provide for transaction account deposits to be available for withdrawal generally on the first business day after the day of deposit. Treasury regulations require that ACH credits be available to the recipient on the day the bank receives credit. Weekdays are to be considered business days except when they fall on a federal holiday. Deposits made after 2:00 P.M. are considered to be deposited on the next business day. When a customer uses a night depository, that deposit is considered received when the night depository is next opened, which would be the morning of the next business day. Deposits made after 1:30 P.M. at automated teller machines (ATMs) owned and operated by Commerce National Bank are also considered to be deposited on the next business day. Case-By-Case Basis For Delaying Funds Commerce National Bank reserves the right to withhold the availability of a deposit according to the permanent availability schedule allowed by the regulation. This means that if a teller notices something suspicious about a customer or a deposit or suspects a forgery, the teller can give the customer a notice stating that the funds deposited will be held. This type hold may be for two days on local checks. The act and the regulation require, however, that the first $100 of aggregate deposits of check(s) not subject to next-day availability, be made available on the next business day. Commerce National Bank will promptly notify depositors of this delay at the time of deposit. Deposits exempt from a case-by-case hold and which must be available on the next business day are the following types:
* Cash Exception Basis For Delaying Funds
In certain cases, Commerce National Bank may hold a deposit beyond the time of normal availability. These safeguard exceptions (not permitted for cash and electronic funds transfers) may be placed in the following circumstances:
* When a deposit is to a new account not more than 30 days old We will notify you if we delay your ability to withdraw funds for any of these reasons, and we will tell you when the funds will be available. The funds will generally be available no later than the 7th business day after the day of your deposit.
